more stress

as most of you know we have got SGO on our c/c now a potential dad has had DNA on one of the children and i am worried sick that he will take me back to court to take the child off me, what i want to know will he have rights to do this (if hes dad) as he had nothing to do with why the parents lost the children to us. he is a drug addict himself and likes a drink aswell so would i be able to say that i want him to have all the assessments that the parents had ie hair strand tests or will i not get a say in it. i just didnt think he would of bothered going for DNA oh god im so worried now

babylove, if he is shown by the DNA tests to be the child's father, then it may be that he is able to be given parental responsibility. That would not change the situation that you have the SGO and have the exclusive right to exercise parental responsibility.

Any decision about removing the child would have to be based on that being best for the child's welfare. It would not happen just because he is the child's father, it would have to be what was best for the child. Given what you have said about his drink and drugs use, I cannot see a court saying the child should be removed from a stable family palcement and placed with him.

It is very rare for an SGO to be overturned. He would have to get the leave of the court to apply before it even got to be considered, and he would need to show that there had been a substantial change in circumstances since the SGO was made AND that it would be best for the child's welfare before he got the leave of the court. It doesn't sound from what you've said as though he could demonstrate either of these things.

thank you for your speedy reply, that has put mind at rest (until 3 o'clock in the morning) i think i will give the FRG line a ring and just see what they say. thanks again x
