Hi everyone, I'm new here (although I have been an avid reader of this forum for quite a while). My question is are we entitled to non means tested legal Aid if we hold P.R? ( We are not biologically related to our little one.)
We were granted an Interim Residence Order with the original LA having an Interim Supervision Order whilst we are going for the SGO. When M came to live with us she was a LAC for about a month then we got the IRO. If anyone can advise me that would be much appreciated.
Also, to you wonderful people who post on this forum, a massive hug and thank you from us,I have spent many a late night poring over your posts I think I have read nearly all! [:I] Although I've been too nervous to post anything before (we are now hopefully coming to the end of our court case), your experiences have definitely made us aware of how to avoid the problems some of you have unfortunately had. I will share our story in more detail very soon. XX

I had looked into this previously but you are not entitled to 'Non mean tested' legal aid - we have an sgo for our gd and have been taken to court by the mother on numerous occasions and she gets legal aid but we have to foot a several thougsand pound bill if we want to be represented - we did ask the solicitor to look into it but its not available to carers in our position apparently, and on looking at the new rules, we are still not assisted in anyway with it.

I can relate our experience of about 6 years back, although if the rules have recently changed it might no longer be relevant. Our Granddaughter was the subject of a local authority care order case, to which we became joined and applied for a Residence Order. At one stage in the series of hearings, we were granted an interim Residence Order. At this point, we had parental responsibility for the child and, as it was a public law case, we became entitled to non means tested legal aid
