divadi, the statement I made last time about the Lewisham judgment still applies. You can read what the judgment actually says here: http://www.familylawweek.co.uk/site.aspx?i=ed1173
I'd suggest looking at paras 52-54 in particular.
You could start by referring the local authority to what is said in that judgment, which was a judicial review of Lewisham's decision to base the allowance on their adoption rate and not the fostering rate. If they don't accept your argument, then you could make a complaint and pursue that. Ultimately you could theaten them with going to the ombudsman or a judicial review, although judicial review can itself be a costly business.
