Hi long story short my husband has been RUI (released under investigation) so no bail conditions, for the last year and 1 month for alleged sexual abuse (no forensic evidence) towards my 14yr old daughter, i am also under investigation for so called perverting the course of justice since January this year (so called telling her to tell the police she lied) , at which point i voluntarily put my daughter into foster care as i felt i couldn't be a parent to her without my feelings affecting my parenting because of what she has done. My daughter has been under camhs for a long time and we have had children's social care in and out of our lives since she was 4 1/2 yrs old due to sexual abuse by my half brother towards her. She has over the years lied, stole and abused myself, my husband and her 2 younger brothers from we beat her, don't feed her etc... she will also do anything to not get into trouble, she plays everyone against us by telling me one thing and them another and she is highly sexualised as she looks at alot of disturbing porn and i have seen messages between her and boys her age where she has lead the conversation into sex. I believe my husband, as much as i don't want to disbelieve my daughter, don't get me wrong i love her but this was the final straw. My husband lives with his parents as we had seperated about a week before her accusation as he has severe depression and we felt it would be good for him to go and get better, she was staying the weekend with him and his parents.
After i was interviewed children's social care decided to start the PLO process, y solicitor has spoken to me and feels that they will never let my husband come home and as we have done everything they ask it may drop down from the PLO.
She has given me two options we leave it and hope that one day in the very long future things will go our way, in the meantime he has supervised contact.
OR
we force them to go to court by putting my husband back with us so that he can have a professional risk assessment and in the hopes of it going our way and after reading your guidance on it i'm more and more inclined to go to court but obviously this comes down to my husbands decision more than mine as its him who would be moving home and at more risk, he feels we should leave it but is thinking about it.
Can anyone gives us advice or opinions on how its gone for them?

It sounds like your family have had a difficult time and the way forward is still very uncertain. Your daughter made allegations of sexual abuse against your husband and you do not believe she is telling the truth. You have agreed to her being accommodated and she is now in foster care. Your boys are still at home with you but to protect them, dad has agreed to move out and is only allowed supervised contact.
The child protection process is at PLO level (pre proceedings). The next legal step is care proceedings. Care proceedings is where the local authority ask the court to give them legal parental responsibility of your children - so they can make decisions about them such as where they will live. Please see our advice sheet about care proceedings. .
At the moment, there is massive delay in any move forward because the police have not concluded their investigation. I can see how frustrating this is and we are hearing it a lot on the advice line as well as this board.
Your solicitor has given you advice on the different steps that could be taken by you and your husband.
Your husband has not yet decided what to do, whether to move back home or remain cooperating with the current plan of having only supervised contact.
If he decides he wants to move home, then he will have to be assessed first. So no decisions about his risk assessments will take place until he agrees to have one.
Another factor is that the police investigation is delayed.
I wonder whether any professional expert assessment of him can take place at the moment? Would an expert risk assessment of him potentially affect his evidence in criminal proceedings? The expert would also want to know the outcome of criminal investigation before he is assessed.
Has your ability to protect your son's been assessed? If children services are worried that you cannot protect your children, you could ask that you attend course such as those provided by the NSPCC and Lucy Faithfull Foundation.
Any move back home by dad should only happen if it is planned by the solicitors along with children’s services. So do as you are doing-keep working with your solicitor.
