Contact and my chances??

Hi there i am a father of a little girl shes 2 years old and my wife and i split up in February 2018 but a month later my wife discovered in my email videos of us engaged in a sexual activity that i had posted onto a site the previous November...she called police and i handed myself in and was subsequently charged with the offence in the July and sentenced to 3 years supervision order on the SOR...250 hours community service and a tag for 8 months. Once the trial was over SW said that because the offence was between 2 adults they would allow my ex and myself to sort out contact between us and we did...we were back out together the 3 of us as a family...my ex and i even started to reconcile and went out ourselves a few times..i apologized for the videos and a was just being a total dafty when a was doing all that. Anyway cracks started to reappear in our relationship again the same things that built up to make me leave in the first place so i said roundabout xmas time maybe we should just concentrate on our child...that was fine but deteroriation happened even more and i asked my lawyer to send her a letter because i had the fear she was gonna take my daughter from me to get everything down in writing but before that letter reached her she saw her lawyer has brought everything back up from last year and now i haven't seen my child since 26th march. Its in the process of going to court now but its just been far too long. But will i get my girl back or will it be supervised even after i have had 8 months of non supervised contact with her??

Thank you for your post.

It seems that you do not currently have any children’s services involvement with your child but there are issues relating to your contact following your separation from your wife.

Children’s services took the decision to end their involvement once your criminal trial ended.

The advice that is offered by Family Rights Group relate to public law issues involving children’s services. Your matter relates to contact which is a private law matter. Normally, I would signpost you to the organisation that offers advice on private law matters but they only advise where the person involved does not have a solicitor. In your case, you do have a solicitor and whilst the court process might be lengthy it is possible that the court could award contact in the interim.

I suggest that you discuss with your solicitor the court process for obtaining a child arrangement order for contact. Your solicitor will no doubt have advised you that the court will decide on contact considering what is best for your daughter and the evidence presented to the court.
