It now gets relay stupid
The clerks at the court of appeal refusing to accept a appeal from us !We are are appealing a order of refusal to grant leave of appeal after an oral hearing in front of circuit judge in a county court and there fore this shoud now go to the court of appeal!Even the circuit judge stated that next step is the court of appeal. she heard the appeal against a district judge in a county court capacity.
any ideas on how to stop this stalemate as i am just the papers back they sending them back to me at £4 at a time!!??

It sounds very complex (and frustrating) if even the court office are getting it wrong. I suggest you speak to the pro bono unit where you can some times get free legal representation.

I,too, wish to bring an appeal about which I have already been in touch with the FRG about by telephone..It was mentioned to me that it is possible to obtain help from the pro bono unit run by the RCJ without a referral from a solicitor. I believe it may be possible to have oneself referred by support groups and family rights organisations. Can anyone advise please?

I'm not sure which organisation my colleague mentioned to you. I will give you details of ones I think it could be.
A referral to the Bar Pro Bono Unit needs to come from either:
1. the CAB;
2. a Law Centre;
3. your MP.
Here is a link to the Bar Pro Bono website for more information.
You can also get help from the RCJ advice bureau and the personal support unit at the RCJ. The links will provide more information.

suzie,thanks for your reply.there is a law centre in manchester but they apparently will not see you;they only deal with certain aspects of the law of which family law is not one.The CAB will not refer me to the pro-bono unit unless I show them all the court documents.I understand I am disqualified by law from doing so. The CAB will not take my word for it that all papers have been looked at many times by lawyers and that I have already been advised by an experienced barrister to apply for leave to appeal unaided by legal funding.My previous solicitors are very uncooperative and will not reply to my letters.Is there any solicitor out there which you or any contributor to these pages knows about who might refer me to the pro-bono unit straight away.I have been to see several but they will not consider it unless I pay them a great amount of money(upfront) to read the papers again.They will not accept that several thousands have already been spent to gain a barristers advice already.Hope you can help.,ange

Unfortunately, FRG are not in a position to take on cases to pursue through courts so we cannot make referrals ourselves to the pro bono unit. Sorry I can't think of any organiation other than the ones suggested.
