ASSISTANCE ORDER. CAO. NRP.

Unread post by FGT676 » Tue Jan 10, 2023 11:36 am

Hi its me again, feel I have nowhere else to turn to :(
Long story short my ex got a cao full time care of our girls and I have contact until March we start overnights. Unfortunately my ex is saying its for 1 night for the rest of their lives and that I only have pr to feed them and have contact.

There is an order so we don't intimidate and harass eachother and we communicate through a parenting app, Unfortunately this is not working as my ex is making sly comments in the app to get me to retaliate but without seeming that way that the children's services would notice.

I have turned to childrens services loads for help and most recently when I could not get my girls back to their dads, I asked him to help and instead he said I'd have to miss that day. There's an assistance order in place and I don't feel childrens services are helping, I still believe this is because I made a complaint. I have done everything asked and continuing to do so. I am wanting to apply to vary the order after march as that is when overnights are meant to start.

I have no support from childrens services and I don't know what to do.

Even with all my proof of passing all alcohol tests and clean liver function tests, getting bereavement counselling and showing sustained change childrens services are still against me.
I have all proof of turning to them for help with my ex showing the coercive control, the sly comments , violence etc yet they still recommended for him to keep the girls which included false reports and lies that I also have proof of. I feel like this is affecting me to be able to spend time with our daughters.

Dear FGT676,

Thank you for your further post.

I am sorry to hear that you aren’t feeling supported by children’s services, especially since a Family Assistance Order was made by the court. Hopefully you have a copy of the of the Family Assistance Order agreement and work plan that was drawn up when the order was made? This document should clearly explain what tasks children’s services should be supporting the family with and what further expectations there are. If you have a copy of this document then I would suggest that you read this thoroughly and then contact a manager at children’s services to explain where you feel that children’s services are not meeting their obligations. If you do not have a copy of this document then I would suggest that you contact the solicitor who supported you during this process and ask them to provide you with a copy. You may wish to consider making a formal complaint if you are not happy with the response from the manager when you have contacted them.

If you need further private law advice in the future you can also contact Child Law Advice and Rights of Women.

I hope that this is helpful,

Best wishes,
Suzie
