Partner under investigation, can we change his bail conditions
Will try to make this as quick as i can. I met my partner about 3 years ago. I have 2 children from a previous relationship and I'm currently 8 months pregnant with our first. Around 6 months ago the police turned up with a warrent for his arrest regarding suspicions of indecent images of children. They took his phone and he was released on bail with the Conditions he doesn't stay at mine when the children are here. Which we have followed. He's said categorically this isn't him and I've gone around with it in my head and I truly do believe it's not him. Social services got involved, the second meeting we had with them they told us that they would be here until the end of the police investigation, that we would need a pre birth assessment regarding the baby and just basically they aren't going anywhere. 2 weeks later she phoned and asked to come see us again and then told us she was closing the case she has no concerns with my partner Around the children and would be more than happy for him to come home and for us to resume being a family. Case closed with them. At this point we had no idea what was happening with the police investigation. So we called the police and was asked to go back in for a voluntary interview which we did. They have said they found a couple of images put onto an icloud account he is linked too but they was automatically deleted and there was more than one device on the icloud. But the only device he owns is the world's oldest iPhone because he's awful with technology. Anyway so they Said they found a few images that were uploaded and deleted therefore the investigation would have to be on going but they couldn't do anything with his bail because it wasn't up for a few more weeks. I spoke to social services and asked what happens now and again they confirmed that their case is closed they have no issues and have no concerns regarding my partner and the children or our baby. His bail is up really soon as well as me being due our baby which I'm having via csection so obviously my life would be alot easier if he was allowed home to help. My question here, what would be the chances of police changing his bail conditions? His solicitor isn't much help at all.

Welcome to the parents’ discussion board and thank you for your post. My name is Suzie and I am Family Rights Group’s online adviser. Congratulations on your pregnancy although I can understand that this is a stressful time for both you and your partner.
Your query relates to your partner’s bail conditions and whether the police can change them which would allow him to return home in time for the birth of your baby and to support you following the birth. Unfortunately, this is not an area on which we can advise as it is outside our remit. Your partner’s solicitor should be able to advise further on this although I can see that they have not been very helpful in this respect. However, your partner does require specialist criminal legal advice on this.
From what you say, children’s services have closed the case and stated that they have no concerns about your partner in relation to your baby or your older children. You explain that you have updated them about the ongoing police investigation and asked their advice in relation to your question about changing your partner’s bail conditions. If you haven’t received written confirmation of their decision and a copy of the assessment they completed I would recommend that you ask, in writing, for them to provide this to you. It is unusual that children’s services change their plans as completely as they appear to have done in your case and that they close and don’t plan to review a situation where there is an ongoing police investigation. So it would be a good idea for you to have this clarified, in writing, as soon as possible. It may also be relevant to your partner’s request for bail conditions to be changed.
