Hi,
I believe the Social Workers involved in our case (CIN only) are discriminating against us based on parental mental health history.
I would add that there have been no problems for some years and a good relationship with MH team.
How do I approach this situation to stop them discriminating against us and start treating us based on reality? (Eg should I complain officially that I believe this is an issue?)
Is their behaviour legal?

Thank you for your post. I am sorry that you find yourself in this situation and believe that your mental health history is being used to discriminate against you during the involvement you currently have with children’s services.
I think it would be helpful to discuss your concerns with the social worker allocated to your case and the team manager. You should be supported and offered appropriate help following the assessment and led to a child in need (CIN) plan being in place. You do not mention specifically any action or inaction on the part of children’s services that you believe is discrimination. There is information HERE about child in need.
Without knowing the specific issue, once you have explained to the social worker and team manager your concerns, if you believe they are not being considered or any appropriate adjustments that you might need to help you is not being provided then you can consider making a formal complaint. Please see information HERE about making a complaint to children’s services.
You may also wish to speak with MIND on 0300 123 3393 as well as the Equality Advisory Support Service (EASS)on 0808 800 0082. If you believe it would be helpful to have an advocate support you at meeting with children’s services then you can ask the social worker for one to be arranged. Alternatively, if you wish to have a family member or friend attend with you then you can do so.
Discrimination of any kind is not legal. Your mental health team may also be able to assist you by speaking with your agreement with children’s services to explain your mental health issues and what would be most helpful to you.
