Vary cao- scared

Unread post by FGT676 » Tue Jan 16, 2024 9:38 am

Hi all so since my last post I have managed to have my daughters sleep 2 nights a week and children's services closed the case and said there is no concerns around alcohol and mental health. We have a family plan in place to continue progressing but unfortunately ex has still controlled the situation and I'm getting support from domestic abuse services. We've had cafcass call and they've done their report and have recommended the local authority to do an updated report on how things are since the last court case. I am worried though as there has been issues with local authority before they closed the case due to lying in the last court case etc. I feel j have no trust or faith in them. I am currently applying to vary the cao to live with both and shared care to fit around my new job and to have the girls home more, what are the chances of getting shared care if it is currently contact 4 days a week and sleep 2 of those days. Unfortunately ex has turned everything around and lied to cafcass , now I'm waiting for the updated report from the local authority but I am just so worried to what they will say after recieving the sar and seeing the lies and not supporting me. I think the only good thing is they closed the case due to no safeguarding concerns. Thankyou.

Thankyou so much. I have received the date for my hearing. This time it has been assigned to a legal advisor at magistrates rather than a District or circuit judge. I'm just wondering is it less formal and why would it have been passed elsewhere?

Dear FGT676

Thank you for your further post.

Please see this explanation of ‘ who makes decisions in the family court’ as it sets out who the different decision makers are and how cases are allocated. The legal adviser assist magistrates.

You may also find Advice Now’s resources on the family court informative. You can find them here.

I hope this helps.

Best wishes
