need help and advice about social care hi

hi there i am looking for help and advice on social care my 3 children are in foster care they have been since 6th of may 23 they haven't got the same foster carer my daughter who's 8 she's on her own while both my boys who's 2 & 4 are together with another foster carer

now i have got a very violent and agressive stepdad who is always under influence of alcohol which he's also abusive aswel he has been contacting social care none stop asking to have contact with just my daughter not the boys for unknown reason he's not bothered about them, i had a ClA meeting and it got brought up that my stepdad wanting to have contact now me and my partner have told them about my stepdad's behaviour which our social worker also is aware of his behaviour aswel. on the 11th of february my stepdad was arrested for going down to my daughters school even thought he knew he wasn't allowed now there in the first place not only that my uncle's wife also took him now in car. when he arrived at the police station he also admitted to stalking without fear/ stress / alarm now on the 12th of february he was in court he pleaded NOT guilty to stalking without fear/stress/alarm so on the 4th of june i had to attend the trail to give my evidence before i got called to the court room i got told that my stepdad didn't turn up so they went ahead with the trial after i given my evidence to the judge i waited to hear the out come dispite my stepdad not turning up the judge found him guilty to the following offences.

The whole of the social care and the manger are aware of what my stepdad is like they also know that he's put my mum in hospital they also know that he fractured her eye socket with a crutch but they are still looking to allow him to have contact with just my daughter
i was wondering if they social care are allowed to let such a voilent man to have contact with my daughter while she's in foster care even thought my daughter has never asked to see him or even speaks about him

Dear HBN45TG,

Thank you for your post and welcome to the parents' board.

You say your 3 children are in foster care; your daughter lives with one foster carer and her two brothers with another. You say you have a violent and aggressive stepfather, who is abusive and misuses alcohol. He was found guilty of stalking after attending your daughter's school and he was physically abusive to your mother. He has asked to have contact with your daughter only and children's services are aware of these concerns. Children's services are willing to allow contact and you would like to know if this is allowed.

Your daughter is under a care order and this means the local authority share parental responsibility for her and that she is a looked after child. They have a duty to promote contact with wider family members, but contact must always be safe and in the best interests of the child. They should also aim to get your views and opinions on this, and to try and agree contact as far as is reasonably practicable.

Understandably, given what you have described, you are concerned about the prospect of your daughter having contact with your stepfather.

I would advise that you put your concerns in writing to the social worker and to the independent reviewing officer (IRO), highlighting the risks that may be posed to your daughter.

You may also wish to make a formal complain about this. Take a look here for more information on how to do this.

Finally, I would suggest that you also seek the advice of a family law solicitor with a view to possibly applying for a prohibited steps order. This order directs the person named in the order not to carry out a specific act, such as to facilitate contact with your stepfather.
