Hi all, I wrote by mobile so I will give only essential information for the moment.
Me and my wife have 2 boys 6 and 3 years old which are in the child protection register until January 2014, we also espect another newborn in the next 2 weeks, now we has been told by the midwife that the SW have send a birth plan to the hospital, we have worked for a while with ss and they have no concern we follow all the plans. Now my question is why the SW didn't tell us about this plan they can take our baby without our consent?
Thanks
forgot: the unborn will be put in child protection tomorrow

Re: Forced adoption?
Hello,
I have just been through this. Your newborn cannot be removed from your care without a court order is the short answer.
Have SS done a Child Protection Investigation or a Pre-birth Assessment? (I would guess so if you have a Birth Protection Plan?)
Was there an Initial Child Protection Conference in respect of your unborn baby? If SS are planning to apply to court to remove your newborn from your care at birth that would have been stated in the outcome of an Initial Child Protection Conference and you should have been clearly informed. Your unborn baby would also likely have been made the subject of a Child Protection Plan.
Do you have a solicitor?

Re: Forced adoption?
Hi the first child protection conference regarding the unborn is planned for tomorrow my wife is 37+2weeks pregnant. We attended know July a legal meeting with solicitors to make a 6w plan for the other children we had to involve solicitors after false allegations written in the PLO. They wanted us to split up but we didn't agree also because they started saying my wife wasn't apparently able to cope with 2 children and a newborn so we strictly followed their plan.
We should have received the report last Monday but the SW said was not ready. She never mentioned any specific plan or pre assessment for the unborn she only stated she has not concerns but want the baby on the register because a baby can bring stress into a family.
Since Monday our solicitor tried to get the birth plan but unsuccessfully

Re: Forced adoption?
Are your two other children in foster care or with you?
Is your solicitor going to the meeting tomorrow? I hope so. If not, don't be afraid to ask questions. The meeting will be chaired and they should make sure everything is explained thoroughly to you. Report the outcome of the meeting to your solicitor as soon as possible if they are not attending with you, and do not sign anything or agree to anything without legal advice.

Re: Forced adoption?
Hi.
They tried to get some signature to allow fostering the other two in may with a senior sw and two police men hen my wife was alone. She didn't want to and forced to go to a refuge with them or they threatened to take her to court.
We never agreed to foster the children are in the family home living with us.
Our solicitor is unable to attend but she is sending a collegue (better than nothing).
Have we any right to read the birth plan? It seems they r trying to hide it if wasn't for the midwife we couldn't know one was sent to the hospital.

Re: Forced adoption?
Absolutely - in fact you should request a copy of it. Normally a Birth Plan is done after a Child Protection Conference and your wife, a social worker and your Midwife should be involved in writing it. It sounds from what you're saying like there is a concern over domestic abuse/violence? Just in view of the fact your wife was encouraged to go to a refuge. Is this the case? If so, it could be that SS do not want you to be present at the birth, and that is why they are writing a Birth Plan. A Birth Plan can stipulate who is allowed into the hospital upon your babys birth and can be enforced by the hospital staff.
It's great that you have a legal representative going tomorrow. Your legal should advise the Chair of Conference that a Birth Plan has been written without your knowledge as this is procedurally incorrect. Make sure your legal speaks to the Chair before the conference commences. And DO NOT sign anything without advice from your legal. Sometimes SS can ask that you sign a Section 20 agreement which would allow baby to be placed in foster care with your consent. This is why you must make sure your legal look over any documents first.

Re: Forced adoption?
Dear BrAjn,
Welcome to the parents forum.
I am sorry that things have been so difficult for you and your family.
I can see that you have had a lot of useful advice from “seeking support”. I am glad that you have a solicitor as well. You might also want to have a look at our film and advice sheet about
child protection.
The child protection conference will have now taken place. Hopefully, you will have more information about the plan that will be followed when your baby is born. It may not mean that you won’t beable to be present at the birth of your baby.
Have a look at this thread on the parents board “Will my partner be allowed to attend the birth of my son” under the heading topic “Are social workers worried about your child”.
You could also have a look at our advice sheet about care and related proceedings which sets out the PLO process.
If there are worries about domestic violence you could speak to respect who have help lines to provide support and advise what courses are available to deal with issues of domestic violence.
Please post back if you need further support and let us know how things are going.
Best wishes,
Suzie
