We was at our 5 day fact finding hearing last week. The judge on Thursday announced she was leaving at 11am that day and the intervenor was being questioned that day, it was meant to be a 2 hour by the fathers barrister, 20 minutes by the mothers and 20 minutes by the guardians. He kept asking for a break and answered hardly any questions. This threw the whole hearing out for times and we now have 2 more hearings.
On Friday following the father being questioned the judge left the court room and as the father and his legal team went to leave they heard the guardian from Cafcass calling him names and swearing about him. Stating how much she hates him and she will do everything in her power to stop him seeing his children. She then turned round and saw him behind her.
The barrister and solicitor for the father advised that it would be their words against hers and won’t help the situation. What realistically can be done & why are they allowing this? This case has dragged on for over a year and the courts and professionals are just not representing the children who have both continuously over this time said they want to live with their father and his partner and their younger sister, they have told them how their lives are with their mum and the names she calls their father, his partner and their child, but they just dismiss it and now claim alienation from my son as his daughter was upset she never had a toothbrush for 3 weeks at home and he spoke with the social worker to say what the child’s worries where and that is apparently alienation?!?

I am sorry to read that the CAFCASS professional used inappropriate language about your son (and the details of his case) a complaint might be helpful, here is a link to CAFCASS' webpage . Your son may wish to speak with his legal team about other ways forward and/or clarity regarding their advice to him.
