Inaccurate and bias assessment by children's services

Unread post by Bubbles77 » Wed Sep 11, 2024 3:46 pm

Can anyone please advise me on what I can do next.
My children currently live with their father. I made a referral to Cs over concerns for my children. Drugs, domestic abuse, string of violent offences, being on a tag. Lots of welfare issues. Alienation.I have a video recording where my ex admits to smacking our daughter. He uses violent words to describe it. I applied to the family court. They ordered a short report. Cs took 23 days to respond to my referral and by then my ex had revieved the court papers and had enough time to coach the children. They only got involved when the police did. The children denied it and the sw told the court my claims were unsubstantiated. Cafcass are to do a s7 report. Cs have done a family assessment. One social worker spoke to me and told me that the school had reported lots of concerns about drugs, things going on in the family home and that they wouldn't put it past dad to be violent with the kids. Two days later a new social worker took over and wasn't interested. Instead i had to defend myself against allegations, getting sars requests etc and disproving. These didnt make the report. My children have told lies which i was able to disprove and again the lies have been put in. He has written a very bias report. Stating no concerns , said the children are punctual to school and that school have no concerns etc. Hasnt looked into any of my evidence. He has said I have said things that I haven't and the concerns from the original sw have disappeared. I recorded all of my interactions and made complaints about the sw however he stayed on doing the assessment. Cs won't listen to my recordings which I submitted through the complaints procedure. They won't answer my questions when I am proving inaccuracies and contradictory information. I am so worried that this will affect the court hearing. I am at a loss as to what to do next. Any help please
Do I need to do anything to be able to use the recording of dad in court?
When would a fact finding hearing be ordered?
Has anyone had success with complaining to Cs and then going to the ombudsman?

Dear Bubbles77

Thank you for your post and welcome to the Forum.

I am sorry to read about your difficult situation.

Child Law Advice and another organisation called Advice Now, may have some helpful information on their websites that can help you with your private law case.

In relation to complaints about social workers, here is a link to our webpages which outline the process and stages of complaints.

If you do not have a solicitor you might find one here at the Law Society’s website, or may be able to get some help from Support Through Court.

Here is a link to Children and Family Court Advisory Support Service (CAFCASS) they have helpful videos about court cases on their website.

Here is some information about using recordings and information about fact finding hearings.

Best wishes
Suzie
