Issues resolutions hearing (mother and baby placements)

Unread post by Summernights24 » Mon Dec 23, 2024 2:11 pm

Hi everyone, I really need help! I’m stressed!!
I’m currently going through care proceedings and my baby who is 4 months old is under an interim care order. I’m wondering if anyone has experience with a judge granting a placement in a mother and baby unit at either the issues resolution hearing or the final hearing? I’ve been engaging with services. I was seeing my son 7 days a week however they thought that was too much on the his carer so they reduced it to 5 days a week. I’m willing to do whatever it takes to show that I can care for my baby. He even had stomach surgery and social services allowed me to stay in hospital with him unsupervised even though contact is meant to be supervised. Any advice or shared experiences would be greatly appreciated.
Thank you.

Dear Summernights24

Welcome to the parents’ discussion forum and thank you for posting.

My name is Suzie online adviser at Family Rights Group, and I will respond to your post.

I see that you are involved in care proceedings and your 4-month-old son is under an interim care order. You wish to know if a judge can say a mother and baby can go into a mother and baby unit to be assessed. A judge can direct for this to happen, but a lot would depend on the circumstances and why this was not possible at the beginning of your involvement with children’s services. You have not given any information about why you would be asking for this at this late stage.

As you are a parent with parental responsibility you are entitled to legal aid for legal representation in care proceedings. Do you have a solicitor representing you in the case? If so, please speak to your solicitor about your wish to be in a mother and baby placement. Also, if you do have a solicitor, they would know the full details of your case and more able to advise you.

You may find it helpful to read about care proceedings

It is not clear from your post what concerns children’s services have about your ability to safely look after your baby. Have a negative parenting assessment?

Did children’s services arrange a family group conference or assess any family member on your or the father’s side to care for your baby if neither of you are able to. Read about family group conference. HERE

It is important for you to understand that the court will be concerned about timescale for your baby meaning that final decisions about his future needs to be made so her can have a settled and stable home going forward.
Your post has given limited information, but as you wish to be in a mother and baby unit do speak with your solicitor. As stated above, it will depend on all the circumstances of your case whether the court would be willing to extend the time for the final hearing to give you an opportunity to be further assessed.

If you wish, you can speak with one of our experienced advisers by telephoning our advice line on 0808 801 0366. The advice line is open from 9.30am to 3.00pm Monday to Fridays (excluding Bank Holidays)

I hope this information is helpful to you

Best wishes

Suzie
