Father of 3 with kids in care caused by the mother

As of april of 2013 ex girl friend/childrens mother has put an epo/dvo against me. She lied on the report and added my kids to it as well, sayin she is afraid that i will take my kids away from her. She has kept the kids away from me for 2 months with no contact. Now, im a great father. I really am. I would never hurt my children or keep my children away from their mother.
After 2 months, the mother messaged me over facebook. We started talkin and she would meet me somewhere to pick up my kids for a few days at a time. Now, remember. The epo/dvo!! If she was so afraid of me. Y on earth would she meet me alone to take the kids for a few days. Then would never call or write me to ask how the kids r doin.. Finally, she gets kids back. A week later, calls me up sayin the kids r gettin taken away from her. They were then placed with my mother in temporary custody. She goes and calls SS on my mother making false accusation. They stated, she would rather have the kids in foster care than with my mother. My mom is a great mom. She raised 3 boys alone with two jobs. Nothing wrong with us. The home is a nice and stable home. My kids had there own rooms and everything. They loved it down there. No reason for my kids to b taken away. She kids mom is facing child abuse and neglect charges. Just recent i had a epo/dvo violation. She was the driver in my car. We get pulled over and i go to jail. Now, get this.. Commonwealth dropped charges against me and now picking it up on her. She is in contempt of her own epo. There is no reason to have an epo/dvo against me and there is no reason at all that the kids cant go stay at my mothers house. Right? I really need help getting my kids back into my care. My kids r 6,4,&3.. They know who they want to b with. And they choose me. But, the cabinet is listening to what the mother wants. And i think its bull. I've always cared for my kids. I did everything for them. And i will do anything for them now. I dont have a lot of money because im on leave from work. I have a great job too. What is it with the world today? I know families that should have there kids taken away. And parents like me gets them taken away over false accusations and lies.. Is there anything i can do to get my children back in my care??

I read your post and have to say that I am very sorry to hear of your situation. I am in the same sort of position as my X year old son is in foster care and has been since March this year. I am faced with him being placed up for adoption as I was ruled out to care for him - however I do not agree with this decision at all.

I too want to place my son with his Grandmother however it has proved very difficult to make this happen because of my sister who has spouted lots of lies about my Mother- we are still trying to get my Son into her care and have the final hearing on the 18th and 19th of November.


I would like to ask you if you have parental responsibility for your children? Also your ex girlfriend sounds like she is not all there. Has she suffered from any sort of mental health issues? I cannot understand why she would favour your children being in foster care rather then living with your Mother.

I can only offer support and someone to talk to about your situation but I think that you need to speak with a good solicitor and talk about your options. If you have a good steady job, a good home and the capacity to care for your children then I cannot see any reason why you would not be able to get custody of your children. The hard task is to convince the Judge.

I’m sorry you are in such a distressing situation.

At Family Rights Group we advise people who are involved with Children’s Services, the new name for social services in England and Wales. I just wanted to check this was the case with you as some of the terms you use indicate it might not be.

Apologies for the misunderstanding if you are in England or Wales. Also, if you are, could you please tell me whether Children’s Services have any orders with respect to your children.
