CMS equal care but still have to pay

Unread post by Koonaz » Thu Jun 26, 2025 8:04 am

Hello, I got a 50/50 court order in December 2023.

Since then, things with my ex are great. My son is much happier and doing MUCH better at school. Things are good!

However I forgot to tell CMS of the court order. They are telling me to pay £300 a month to my ex.

So I provided them the court order and they have updated the portal to say "Equal care" but that i should still pay £40 a week??

Anyone seen this before? The court order clearly states equal days/nights.

Dear Koonaz

Welcome to the parents’ forum and thank you for posting.

My name is Suzie, online adviser at Family Rights Group and will respond to your post today.

Unfortunately, your query does not fall within the remit of our service as we offer advice where children’s services is directly involved in respect of the children in a family.

I suggest however that if you are unhappy with the amount the child maintenance service (CMS) has requested you pay that you ask them to explain how they calculated your payment. I believe it would be based on the number of nights spent with each parent but am not able to offer any advice since, as stated above, it does not fall within the remit of the service.

Best wishes

Suzie
