Help to get my son back into my care

Hello.

I am new so I am sorry if there has been a post about this sort of thing already.

My parents have a Special Guardianship Order over my son, which was put in place as Social Services, at the time, thought I may get into another abusive relationship. I was also asked to see a CBT counselor. I did and she said I was fine and did not need help.
I am at university now and wish to move into my own place in my second year with my son. I want to go back to court and have the SGO taken off, amended or a residency order put in place. I have heard all these things can happen.

I guess I was wondering, how I go about it? How do I apply to the courts? Will the courts ask for Social Services involvement again? How long does it usually take? How much are court fees? And anything else that I may know.

Dear Tinksabell

You may find it useful to look at our advice sheetspecial guardianship orders for parents .

This provides some useful information for parents trying to take their cases back to court after a special guardianship order has been made, and should answer most of your queries. However, in terms of timescales, this probably depends on the court's availability, so I am afraid I do not have any more information to hand.

You may want to consider speaking to a Law Society Solicitor, one who is a member of the Children's Panel. They will be able to advise you further about court costs and your entitlement to public funding.

In any application to the court, you would need to get the permission of the court for them to have your case heard. Then you will have to demonstrate a significant change in your family circumstances since the court order was made, in order to have any chance of a successful outcome.
