yes but they might ask why also they may go ahead and prosecute anyway it depends on the situation.
Try netmums too the posters on there are a font of knowledge too as this site mainly deals with social services.

My advice would be to speak to the police directly about this or to seek some proper legal advice from a solicitor if possible. If you are unable to access a solicitor, you could try the Civil Legal Advice line or your local Citizen's Advice Bureau.
