I have posted on here before about my situation..where my ex broke my sons arm and upon sending X-rays away after being told they are clear we was told there an old fracture to his leg that he showed no sign of pain with
Anyway I am currently on bail after being interviewed and due back may 1st
Iv had the first court hearing and images are being sent away to confirm if there is a healed fracture to his leg..also due back there once results are back..( also my friend had an assessment to care for him if needed n the so pal worker told her that there was 2 pieces of evidence saying there a fracture but only one was presented in court..weather that one came back after court I don't know but I had no idea about it)
So my question is can the police keep me on bail even with no evidence that I did his leg..I know 110% I didn't do it..my gut feeling is he did it when he fell off my bed..but obv I can't rule out his dad cos he broke his arm..I'm worried they will keep me on bail until care proceedings are finished..my son has no choice but to be adopted then they realise me off bail once it finished.
I have no idea how it works..I just want to clear my name and have my son back my parenting assessments are going fab..the people supervising have even said to me I can tell you didn't do it..you two are clearly very close..will my assessment be shared with the police? I mean it didn't get written down that one of them said he can see I wouldn't hurt him I guess he not allowed to actually make assumptions like that..

Dear dellie4eva,
It sounds like you have nothing to worry about as regards the policeunless they have received evidence against you which you don't know about.Has someone made allegations against you( your ex who broke the child's leg,a neighbour or relative ) which suggests that you are culpable or that you failed to protect the child or that you put him in danger. Do you get drunk, take drugs, leave the child alone with others ( such as your ex.) whilst you go out partying ? If so, there will be valid concerns.
Don't get carried away,I'm only supposing not accusing you.
As the Police have bailed you without conditions,it is likely there isn't anything and they are awaiting further developments.Your solicitor will tell you what evidence the police have. Find out then get back to us on the forum.
In the meantime, Suzie ( of the FRG) will probably advise you in a day or two.

Dear dellie_4eva
My name is Suzie, one of the Family Rights Group's online advisers. I am sorry to hear about the difficulties you are experiencing in relation to your situation.
What has your solicitor told you about the information (or evidence) that the police have about you? They are best placed to provide you with these facts.
I assume there is a joint child protection investigation being conducted between the police and Children's Services at this time. Whereas the police are concerned with criminal enquiries and a burden of proof beyond reasonable doubt, the Local Authority on the other hand need to establish if your child has suffered or likely to suffer signficant harm.
In cases where it is inconclusive you may still be treated as a suspect and a risk assessment will be conducted to see what if any action needs to be taken.
Can I also suggest you seek further information from your solicitor who can help you plan the best way forward.
Best Wishes
Suzie

Re: Bail and. Are proceedings
Dear delie4eva, The answer to your specific question is yes, The Police can keep you on bail and may well do so until care-proceedings are over then drop any case or charges.
Is your child still under the S20 or has the Court granted an order? If so, what kind?
If not, does your solicitor still say there is insufficient evidence to remove but he doesn't want to take that route?
Try and stick to this one thread from now on.
