Hi,
I am looking for help or advice on how should I get a residence order for my son.
His mum left the country in October after a traumatic process of going through our divorce and an order by the social services so to him moving to leave with me till further notice.
He lived with me for the last year and four months and feels great and settled. She wants to spend more time with him now and this summer holiday that is coming.
I don't know how to proceed and bearing in mind how angry she left and now insisting that he needs her and must spend his summer holiday in her house in the European country where is she from.
I have this feeling that for him will be more stressful than a quality time for him. How can I obtain a residence order if his mum is abroad..?? Would it be possible and what steps I have to take..??Would it be possible to make some kind of legal agreement with her...??
Thank you very much for any advice and understanding.
Kind regards.

Dear Murzilo,
Thank you for posting on the parents forum.
Your questions concern private law court applications. Since April, Residence Orders have been replaced by a similar order known as a Child Arrangement Order. To get advice about this order and other private law children orders you could contact the Coram Children's Legal Centre.
I do want to raise the following issues :
1) You say that children services insisted that your son live with you until further notice. If you are thinking of allowing your exe to have extended contact with him-over the summer, then I suggest that you speak to children services about this. I can see that you think this might be stressful for your son. They may have concerns about this contact arrangement, like you do.
2) Do you worry that your exe may not hand your son back? Depending on which country your exe resides in-you might find it difficult or impossible to force your exe to return your son. If you think your exe might not return your son, why don’t you speak confidentially to the advice line at
Children and Families across Borders.
I do not want to worry you but I think you need to think of all possibilities.
Best wishes,
Suzie
