Hi everyone. Well what a week. Some members of this forum will know that at this point we should be returning to court. The judge made it very clear what she expected of the LA in December. If no adopters found in 6 months she wanted a revocation application before her by the end of next month (court ordered). Well, well, well, surprise, surprise...... we've heard absolutely nothing. Nor have our solicitors. There should've been a meeting over a week ago where a final decision should've been made (again court ordered). One solicitor doesn't even think it took place!
I've read elsewhere that social workers can be held accountable if they don't comply with court orders with penalties such as imprisonment for offenders. It's been the case the whole way through that they've thrown so much mud they reckoned some had to stick so they got their orders. Time's up and they're throwing their toys out the pram and avoiding both our solicitor's questions and a barrister's.
Can anyone tell me if we have any recourse if that's the right word to hang them over this? Our kids miss us like crazy that was evident yesterday and it's tearing our hearts out.
I have a meeting with my solicitor next week about getting funding for legal aid. Does anyone know if it's both means and merit tested now? I don't work because of health problems mostly brought on by the situation and my husband earns less than 22k a year.

Dear charmed,The LA breached court orders in my family's case , one of which was to produce material evidence of our family background to court and withdraw the wrong background (of another family) from proceedings). They failed to produce and sent all the irrelevant background to all the expert assessors( psychologist,paediatrician ,independent parenting assessors and the Guardian).This was incredible to me especially as we were relying on the correct background to prove our claims.
The judge apparently did not notice or just ignored that the court's orders had been flouted.Afterwards,I was advised by my lawyers they would not apply for legal funding as they were wasn't enough merit in the case to win an appeal.So it depends on your lawyers whether they apply or not.
Suzie will probably give you advice soon and recommend your best course of action now.At least she should know if they have acted illegally.The CS couldn't care less really about children.Because of their neglect our son languished in a so-called temporary placement in a residential care home for almost 3 years.The judge hardly raised an eyebrow.The CS seem to do what they want!
