Unread post by dvsurvivor » Wed Sep 24, 2014 7:25 am

As i have every legal right to as i have equal pr and shared residency with the father of my child.
He breeched court order and kept my child after contact. I kept on at social services with my concerns. They finally did an assesment that led to a s.47 report which led to my child being on child protection at at risk liveing with him. My other kids that live with me social service have no concerns. Social service recomended he return the child he has kept to me. He wont!
I am exstremley worried about my child. What if i just went and collected from school as would be safe with me. What would happen if i did that would i get in trouble? I have listened to proffesinol advice for a year now. Has got me no were! Just delays, delays, delays. As my ex kmows the legal system and constantlg puts a spanner in the works as regards private law. Please help me im despedate and fed up of waiting and constantly worried about my little one. I just want to go rescue my child and feel so powerless.

Dear dv survivor

I am sorry that you are still distressed by the situation regarding your daughter.

Following your post last week a full response was posted regarding the procedures being undertaken by Children Services regarding your daughter. You were also advised in respect of the private law proceedings which you posted you had started. I am not able to add anything further to that advice.

It is a decision that you have to make as to whether you collect your daughter from school. However, I think it is very important that you consider the impact on your daughter of being in the middle of her parents after school. As there is a Child Protection Plan for your daughter I do not know what Children Services have said you should do under the Plan regarding your daughter.

Whilst I sympathise with the situation you find yourself in at the moment, you have taken the correct steps in making an application to the court.

If you were to take your daughter from school, what would you do about her having contact with her father? From what you have said there is a court order for contact and if you did not allow contact you would then be in breach of the court order.

I know that you are finding the delay difficult but you should think through any action you take very seriously as the final outcome may not be the one you want.
I hope this helps.

Best wishes,

Suzie

Thankyou for your reply Susie and that is exactly why i have not gone to the school to collect her even though i would of gone at an earlier time than useal pick up time to avoid confrontation. And i do not want to be classd as nad as him and useing my daughter as a paurne.
As part of the s.47 assesment my daughte is at risk from sexual abuse and her father has to have specialised risk assesments as regards sexual abuse. As children from more than one area have made alligations. So this is why im so desperate to get my daughter and am worried sick.
