Disrupting an adoption

Unread post by Mum_of_2 » Sat Mar 21, 2015 7:41 pm

My husband and I adopted 2 brothers (full siblings) 10 years ago.
The eldest is on conditional police bail and in foster care currently.
For a number of reasons we are seriously considering disrupting (reversing) the adoption of our eldest to safeguard the 3 of us at home from any further damage, both physical & psychological.
Can anyone offer us any advice how we proceed with this as local services are not being forthcoming with information.
Thanks in anticipation.

Thank you for your post.

My name is Suzie and I am an adviser at Family Rights Group. I'm sorry to read about the difficulties you and your family are experiencing.

It is not possible to overturn an adoption order. This order gives you permanent parental responsibility (PR) for your sons and, as with a birth parent, the only way this PR could be removed would be if they were adopted by someone else.

If you feel that it is not in either of your son's best interests for your eldest to return to the family home, you can request that he continues to remain in the care of the local authority under parental agreement (accommodated under section 20 of the Children Act). Alternatively, you may suggest that your son is "beyond parental control" and that it is appropriate for the local authority to issue care proceedings and apply for a care order on your son. If granted, this care order would give the local authority parental responsibility for your son, shared with you.

We have a number of advice sheets that may be of assistance to you including about the responsibilities of Children's Services when a child is in care, family support services and care proceedings. Given your specific situation, however, you may find more specific advice from an organisation such as After Adoption

I hope this helps

Best Wishes
