If my ex partner has admitted to accidents to SW but in the court bundle is saying there is no way he could have accidentally or purposely have hurt my LO, will that be flagged up in court?

How can he admit to things and then just take them back?

Worried as we're both in the pool.

Welcome to the parents’ forum. My name is Suzie and I am an adviser at Family Rights Group. I hope that the following advice is helpful.

From the information you have given it sounds as if care proceedings are in process for your child. Your child was hurt and it has not yet been established who is most likely to have caused the injury. You believe that your ex-partner previously told the social worker that he may have caused an injury through an accident however in the court bundle it states that he said that he is sure that he didn’t cause the injury (either accidentally or purposefully).

I would suggest that you discuss this with your solicitor as soon as possible as they will be able to advise you as to whether they think that this should be raised in the next court hearing. The court will need to make a decision as to who is most likely to have caused the injury and they will take into account what statements the people in the pool of perpetrators made and whether there is any conflicting evidence. If you have any evidence (e.g in emails or text messages) documenting that your partner did tell the social worker that he may have caused the injury accidentally then it would be important to make sure your solicitor has a copy of this.
