Hi,
My son was put under a SGO with my mum around 2 and a half years ago due to my ex partner being extremely violent and there were risks for both me and my son, all of situation has changed I am no longer with the father, have been working on myself for both me and my son! I see my son when my mum allows me too, I just wanted to know if there’s any advice on how I can go about trying to revoke the order?
Want help to regain custody of my son who is under an SGO

Dear Hopefull Mum,
Thank you for your post and welcome to the Parents’ Forum.
My name is Suzie. I am an online adviser and I will be replying to you today.
It is so good to read that you are now free of the abusive relationship and that you continue to make positive changes. I agree that all of this is of massive benefit for your son as well as yourself. I hope that the contact you have with him is going well and you are able to enjoy the time together even more now.
You can find information for parents about Special Guardianship Orders including applying to revoke or discharge the Order here Special Guardianship Information for Parents
You will see from this information that to discharge or revoke the Special Guardianship Order you will need to apply for permission (leave) from the court.
To get the permission you will have to show that there has been a substantial change in circumstances since the Special Guardianship Order was made and that it is in the best interests of your child as well.
I hope that you are able to discuss your possible future plans with your mother/your son’s Special Guardian so that you and she can focus on what is now in the best interests of your son and how you can best work together on this.
If the Special Guardianship Order for your son was made less than three years ago, Children’s Services still have a responsibility to support the placement, so it may be useful for you to request a discussion with a social worker from the Special Guardianship Support Team.
I hope that this reply was useful to you.
If you would like any further advice or information then please post back on this forum. If you prefer, you can speak to an adviser on our freephone advice line (0808 8010366), Mon to Fri, 9.30 am to 3.00 pm (except bank holidays). You can also send an advice enquiry email or use our webchat facility.
