ICO and Foster Care

Unread post by enigma » Thu Sep 05, 2024 1:51 am

The local authority have made an application for private family proceedings to be made public. The social worker has been dishonest throughout the private proceedings. The reports contain comments which are not factual at all.

At a hearing recently the judge refused to look at applications I submitted with evidence that proves beyond doubt the social worker has made deliberate fabrications to the court. Evidence was also submitted my ex is using the courts and statutory organisations to coerce and control me.

I have told the matter is public now, a final decision will be made I was told it's possible my children will be taken into foster care at the final hearing.

If the children are taken into foster care are they taken immediately? if yes, what can be done legally to stop them being removed. If an order is only made for foster care what happens and can it be appealed?

I am very concerned my children will be removed from my care due to the deliberate false allegations made by the social workers despite having evidence to prove what they submitted is not factual.

Dear enigma

Thank you for your post and welcome to our Parents Forum.

I am sorry to read that your private law case has now become a public one and that there is an interim care order in respect of your children.

You ask what can be done legally if at the final hearing a decision is made that your children must live in foster care, the making of the care order is 'legal', you can read about the court processes here. In all cases the welfare checklist will be complied with.

Your solicitor will be able to advise you on the specifics of your case. You asked about appeals, here are our webpages about appealing decisions. Our guide about working with solicitors may be helpful to you as may the one about working with social workers.

Best wishes
Suzie
