Pregnancy, clares law and social...

Unread post by Mam1989 » Tue Jan 28, 2025 8:38 pm

Hey, newbie here...
I have 2 children who don't live with me due to my mental health but do have unsupervised access to them when they come over to my house. They reside with their dad & grandma.
I am currently 23 weeks pregnant with my current partner and am aware of social services being involved which is absolutely fine and I have been fully cooperative etc.
Current partner has a past with his ex (mother of his 3 children) all 3 put into the care system by their mother... and from him, his mother and the 2 oldest children their mother is manipulative, liar and controlling. Anyway fast forward now to me being pregnsnt my social worker has said she wants to do a clares law on my partner which is fine as he has told me there was volatile sides to their relationship and he has disclosed she sent him to prison but he was acquitted for violence... she was abusing him but he didn't reach out because not many people do. What I'm trying to say is does anyone predict an outcome of this clares law and my pregnancy/baby... surely they have to look at the alligations she has made against him as I have done research and it is possible to lie on police files which are then on record/clares law... surely if can pursue the fact that she infact abused him and lied etc then there is a loophole in regards to them tarnishing him?
Any advice appreciated 🙏 thank you ♡♡

Dear Mam1989,

Thank you for your post and welcome to the parents’ forum. My name is Suzie, and I am an online adviser responding to you today.

Congratulations on your pregnancy. You describe how you are working collaboratively with children’s services and accept that a Clare’s Law or Domestic Violence Disclosure Scheme regarding your new partner is planned as part of the assessment of any risk. A factsheet on the Domestic Violence Disclosure Scheme is here.

The Family Rights Group web pages on how children’s services work with parents to be is here. The page for mothers may also be useful here.

You are worried that if any history of abuse allegations or investigations come to light that are of concern to children’s services this may ‘tarnish’ your partner or be seen to present a potential risk to your unborn child.

You ask if you can find a ‘loophole’ via examining the alleged abusive behaviour of your partner’s ex.

I can understand that this is a stressful time, and that you fear that if there is information disclosed about your partner it may not give the full picture. However, it would be more practical to focus on any concerns raised by children’s services IF there is a discussion to be had after the Clare’s Law disclosure. If there is a risk to be considered children’s services assess whether a parent is willing to work with them; can discuss any concerns raised and accept any support needed to address the difficulty.

Respect are a domestic abuse charity that work with male perpetrators and male victims of domestic abuse and your partner may find useful information and advice from them. A link to their website is here.
Family Rights Group have links to other domestic abuse support agencies here.
