Children services

Children's services have broken some of the sections in the children's act does anyone think I should revoke the care order I've just got and take it back to court my daughter is suffering in there care and children's services are aware of this

Welcome to the parents’ discussion board. Thank you for your post. My name is Suzie. I am Family Rights Group’s online adviser.

I am sorry to hear that your daughter is in foster care. You are concerned that children’s services have acted unlawfully. You are considering applying to end the care order for your daughter. You are also worried that she is suffering in the care of children’s services.

If you are worried that your daughter is being harmed in any way then you should let her social worker and the Independent Reviewing Officer know the reason that you are concerned as soon as possible. You can discuss your concerns by phone but it is best to put them in writing too. Children’s services would need to consider this and let you know their response.

I am adding a link here to advice about children in care under a court order which may be helpful to you.

I am also sending a link to complaints so that you know more about this process.

I cannot advise on whether you should apply to end the care order at this time or not. However, as you are considering doing this you may find this information helpful:

The law about discharging (ending) care orders is in section 39 of the Children Act 1989. It says that an application to discharge a care order can be made by:

 Children’s services
 The child themselves
 Anyone with parental responsibility for the child. Remember, a parent or person with parental responsibility does not lose this when a care order is made, but their ability to exercise it is limited).

If a parent wants to apply to discharge the care order, they will have to show real change in circumstances since the order was made.

If an application has already been made to discharge a care order in the last six month then the court’s permission is needed before applying again (see section 91(15) of the Children Act 1989).
